Was Vehicle Towed: - | Description of the Complaints: I own a 1995 eagle talon which has a safety recall, nhtsa campaign number: 00v421002. i was not notified of the recall by the manufacturer. the recall was discovered when the lower ball joint seperated as i was driving the vehicle. fortunatley there was no accident. the dealer will not replace the right broken ball joint with the newly designed lateral arm ball joint free of charge. the ball joint i have referred to is the original equipment which was installed on the vehicle at the time of delivery to the first purchaser. the dealership also stated that the left ball joint is also defective and unsafe and needs to be replaced with the newly designed lateral arm ball joint. their reason for not complying with the recall free of charge is that the vehicle had been lowered. the lowering of the vehicle did not involve the replacement or alterations made on the ball joint lateral arm in any way and does not make the vehicle more difficult to repair. it does not change the fact that the lower lateral arm ball joint is defective and unsafe. the manufacturer did not comply with federal regulation 49 cfr part 577 requiring notification to purchasers of safety recalls. (chrysler has my owner information on file.) title 49 of the usc states the manufacturer is responsible to replace free of charge, any safety- related defect of an item of original equipment. thank you. *la |
