Was Vehicle Towed: - Description of the Complaints: I am filing a complaint against interlock device manufacturer smart start based in irving texas, and their affiliate dealer accurate interlock of harrison township michigan. i had a smart start interlock device installed in january by accurate interlock of harrison township. on february 9th i left the device in the car and water froze in the breathing tube, and trying to get my car going i poured water into it, causing it to not work for the day. however, on one of the final attempts (64 unsuccessful attempts logged on the device that day) by some electronic malfunction it registered positive for alcohol. the related legal issues were settled in march. i am writing the nhtsa, because this agency certifies these devices. when i contacted smart start's headquarters and spoke with their head engineer, abraham garcia in early march, i relayed all the details of my actions on 2-9. his response was that he "didn't know if he believed" my story and he provided no assistance. no tests were conducted despite the highly suspicious circumstances that caused the judge to rule in my favor (i also passed a polygraph test). all the while the company has held only alcohol as a possibility of a source of the error, at the cost of several thousand dollars to me. there is no incentive for this company to admit error aside from proper oversight from your agency. in fact they even denied the possibility that ice could form in the machine. their lack of knowledge of their equipments function, and refusal to investigate well-substantiated claims is inexcusable. please act on this claim before it happens again to someone else. if you'd like any further information please contact me. if there is anything further i might do, local agencies i can contact please let me know. thank you for your time. *tr
